Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and The Creators Company ("The Creators Company", "we", "us", or "our") and govern your access to and use of our marketing website, our creator dashboard and storefront platform at app.thecreators.company (and on creator custom domains), and our AI assistant connector (together, the "Services").

By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Definitions

  • Platform — the software, tools, and infrastructure we provide.
  • Creator — a user who operates a storefront and sells products through the Platform.
  • Customer — a person who buys or accesses products through a Creator's storefront.
  • Content — anything uploaded, created, or sold through the Services, including products, courses, videos, files, pages, text, and media.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. Notify us promptly at [email protected] of any unauthorised use.

3. The Services

The Creators Company lets Creators build branded storefronts, sell digital products, manage course content, accept payments, and receive payouts. We may add, change, or discontinue features at any time. We do not guarantee uninterrupted or error‑free operation.

4. Creator responsibilities

As a Creator, you agree that:

  • you own or have all rights necessary to sell and distribute your Content;
  • your Content and storefront comply with all applicable laws and these Terms;
  • you are solely responsible for your products, descriptions, pricing, delivery, customer service, and any promises you make to Customers;
  • you are responsible for determining, collecting, and remitting any taxes applicable to your sales, except where we are legally required to handle them;
  • you maintain a relationship with, and your own lawful basis for processing the data of, your Customers; and
  • you will complete any identity verification ("KYC") we or our payment partners require before payouts.

5. Acceptable use

You may not use the Services to upload, sell, or distribute Content, or to act, in any way that:

  • is illegal, fraudulent, deceptive, or infringes others' intellectual property or other rights;
  • contains malware, or is intended to disrupt, overload, or gain unauthorised access to the Services or others' systems;
  • harasses, defames, or harms others, or is sexually exploitative of minors;
  • violates the rules of our payment, hosting, or infrastructure partners; or
  • attempts to circumvent fees, security, or access controls.

We may remove Content, and suspend or terminate accounts, that we reasonably believe violate these Terms or the law.

6. Fees, payments, and payouts

  • Subscriptions. Some plans are paid on a recurring basis. You authorise us (through our payment processor) to charge your payment method on each renewal until you cancel. Fees are described on our pricing page and are non‑refundable except as required by law or expressly stated.
  • Commission. We charge a commission on sales as described in your plan. Payment‑processing fees charged by our payment partner also apply.
  • Payments and payouts. Payments are processed by Stripe and are subject to Stripe's terms. Payouts to Creators are made to a verified account after any applicable holding period, once verification ("KYC") is complete and minimum thresholds are met.
  • Refunds and chargebacks. Creators set and are responsible for their own refund terms with Customers. You are responsible for chargebacks, disputes, and related fees arising from your sales, and we may deduct or recover these from your balance.
  • Taxes. Amounts are exclusive of taxes unless stated. Each party is responsible for its own taxes as described in Section 4.

7. AI assistant connector

The Services include an optional connector that lets you manage your storefront through third‑party AI assistants (such as ChatGPT by OpenAI or Claude by Anthropic).

  • Use of the connector is optional and requires you to authorise it.
  • Your use of the AI assistant is also governed by that provider's own terms.
  • AI‑generated suggestions and changes may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing any change before publishing it, and you remain responsible for your storefront and Content.
  • We are not liable for actions you take based on AI output, or for the AI provider's own processing of your prompts and data.

8. Intellectual property

  • Your Content stays yours. You retain ownership of your Content. You grant us a worldwide, non‑exclusive, royalty‑free licence to host, store, reproduce, adapt (for formatting and delivery, e.g. video transcoding), display, and distribute your Content solely to operate and provide the Services (for example, to show your storefront and deliver products to your Customers).
  • Our IP. The Platform, software, and our trademarks are owned by us or our licensors. These Terms grant you no rights in them except the limited right to use the Services.

9. Third‑party services

The Services rely on third parties, including Stripe (payments), BunnyCDN (video), Cloudflare (domains/security), and AI providers (the connector). Your use of those features may be subject to the third party's terms, and we are not responsible for third‑party services we do not control.

10. Suspension and termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law or our partners, or to protect the Services or other users. On termination, your right to use the Services ends; provisions that by their nature should survive (including fees owed, IP, disclaimers, limitations of liability, and indemnities) will survive. Your storefront will be deactivated, and we will handle your stored Content in line with the retention terms of our Privacy Policy — where practical, giving you a reasonable opportunity to export your data first. Any payout balance owed to you remains payable to your verified account, subject to applicable holding periods, identity verification, refunds, chargebacks, and minimum thresholds; any fees or amounts you owe us remain due.

11. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Services will be uninterrupted, secure, or error‑free, or that content (including AI output) will be accurate.

12. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Services will not exceed the greater of the amounts you paid us in the 12 months before the event giving rise to the claim, or USD 100. Some jurisdictions do not allow certain limitations, so some may not apply to you.

13. Indemnification

You will indemnify and hold harmless The Creators Company and its officers, employees, and agents from claims, damages, and expenses (including reasonable legal fees) arising out of your Content, your products, your use of the Services, or your breach of these Terms or applicable law.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and change the "Last updated" date, and where required we will give additional notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
